Are there any legal requirements needed to perform a direct cremation?

There are different legal requirements in Spain for direct cremation when a family member dies.

  1. A judge may not authorise cremation in the case of a judicial death. Due to legal reasons the judge may reject cremation options. 
     
  2. Cremation may not be performed if the deceased person has received internal radiation therapy for a prostate tumour within the last 8 months. 
  3. In the event that the person wears a pacemaker, notification must be given for its removal. Removing this device is mandatory before starting the cremation process.

 

In order to start the procedures after a death it is necessary to have the following documentation:
 

  • The medical death certificate.
  • The DNI or supporting document of the deceased person.
  • The DNI or supporting document of a declarant, who will be the person who declares the death, provides the documentation and signs all the necessary authorisations to carry out the whole process.
